MADE WITH BARAKAH TERMS OF USE AGREEMENT 

Welcome to Made with Barakah ("Made with Barakah"),

By accessing or using our website and services located at madewithbarakah.com as well as the related mobile website, you agree to comply with and be bound by the following Terms of Use (this “Terms of Use” or “Policy and Terms of Use” or "Agreement") and conditions whether or not you are a client of Made With Barakah. If you wish to become a client and/or make use of the service, please read this Agreement. If you do not agree to these terms, please do not use our website or services.

1. Services 

Made with Barakah offers one-on-one nutrition counseling sessions and nutrition packages ("Services") that may include a combination of initial consultations, follow up sessions, progress check-ins, and educational functional nutrition resources as described on our website. All services are evidence-based and tailored to each client’s individual needs.

2. Eligibility

In order to use the Service, you must be at least eighteen (18) years of age. By using the service, you represent and warrant that you have the right, authority and capacity to enter into this Terms of Use Agreement and to abide by all of the terms and conditions of this Terms of Use.

3. Intellectual Property

All content, designs, graphics, text, and materials provided by Made with Barakah are protected by intellectual property laws. You may not reproduce, distribute, modify, or use our materials without prior written consent.

4. Health Disclaimer

The information that you receive from Made with Barakah is informational by nature. Made with Barakah does not offer any medical advice or medical opinions. You should consult with your medical professional(s) prior to use of the Service and stop using the Service immediately upon your medical professional’s recommendation. The content or any nutritional advice received is not intended to be a substitute for professional medical advice, diagnosis or treatment. 

5. Payments and Refunds

Payments for Services may be made through the Get Healthie platform, our HIPAA compliant patient portal system, using the payment processing provider, Stripe which accepts all major credit cards. All refund requests will be reviewed on a case-by-case basis.

6. Rescheduling and Cancellations

In order to cancel or reschedule a session, please contact us at least 24 hours in advance. Cancellations made with less than 24 hours notice may be subject to a no show fee.

7. Confidentiality

Both parties agree to treat all counseling related information as confidential. Confidential information shall not be disclosed to third parties without written consent. All client information, including session notes and communications, is kept confidential. Your personal data will only be shared with your explicit consent or as required by law.

8. Limitation of Liability

Made with Barakah shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use of our services or materials. While we strive to provide accurate, reliable, and evidence-based nutrition advice, Made with Barakah is not liable for any injury, illness, or adverse health conditions that may arise from using our services or implementing the dietary recommendations provided. Clients assume all responsibility for decisions made based on the information provided.

9. Indemnification

Clients agree to indemnify and hold Made with Barakah harmless from any claims, damages, liabilities, or expenses arising from the use of our services.

10. Governing Law

These terms and conditions shall be governed by and construed in accordance with the laws of the State of Texas. Any disputes shall be subject to the exclusive jurisdiction of the courts in the State of Texas.

11. Modifications

Made with Barakah reserves the right to modify or update these terms and conditions at any time. Clients are responsible for reviewing these terms periodically.
